We are 74 contributors to this campaign by my count...and not everyone posts here...not to mention 4 outstanding challenges that must be met :D
Thank you all for responding to my request, i feel honored to be a part of this group. 74 out of 3,000 members is still a drop in the ocean though, please continue to encourage all the bystanders, contact friends, post on active threads, whatever it takes...we need this...for us.

the law is not an end in itself... it's a means to achieving end.... and hence it can be challenged in the courts...
final point... let us walk through the situation... per quota country limits is removed... now everyone applying for the employment based visa has to wait for 5 years.... so every country immigrant & the country politicians will pressure the US govt. to act... and only then politicians would act!
case in hand: Labor Certifications... Before PERM it took upto 3 years for the labor to be certified and it affected everyone irrespective of the country... So the PERM was introduced.
AC-21 ... before AC-21 everyone was getting affected and hence the AC-21 law..
One may argue otherwise... but the reality is it matters especially if everyone is getting affected... However, we try... the family based visa won't go away... it affects everyone! No surprise that the latin american senators would NOT allow any legal immigration efforts to succeed without their cause being taken as well.
The only way a thing will get done is if we have a mass problem... and if there isn't then as a tactic it is necessary to create one so that the whole problem could be solved. Otherwise everything will be lost in statistics like
1> Only 2% of countries are getting affected.
2> Only IT/electrical/software are getting affected.
3> Out of the affected people only 5% are leaving, overall only 2% are leaving.
4> etc. etc.
Please note the above numbers are my guestimates.. but I hope you got the point. I am ready to bet the day per country cap is removed... within a year something would be done about the whole EB immigration.
The human psychology is to be risk averse that is if something does not affect me then why should I bother myself with it? In other words, unless many people do not get affected, there won't be reform/change/resolution!

So they are not selecting based on Merrit as no compettion is there for the particular position. So it is just all the eligible persons will get GC. It is similar to all the high school passed candidates will get admission to college if seats are available but not based on marks but based on FIFO basis.
By FIFO based it is discriminatory but still unused other country quota is used in last quarter for India and China. So per country quota impact will be less if CIS uses all the 140K. Also they are not giving any one country preference or quota. So it is not outrageous compared to many other controversial laws. Law in any country is not perfect and even if perfect it will give more benefit to some group.
It is very difficult to win by lawsuit against any law unless that law is outrageous and impacts many persons. So best way is to try for another law to change a law. But just removing per country quota will give very less benefit especially for Eb3. Waiting time will reduce from 7 to 6 years for all countries. Please dear god..... let them consider priority date instead of the notice date. Mine is Oct 15th 2007. Our priority dates were current for three times and our application never touched, all our friends March 2006 to Jun 2006 filers got their cards a couple of years ago....:rolleyes:

Pascal ... I really admire your straight thoughts. I am watching this EB2 Vs Eb3 uproar from last couple of months. Its amazing that we are more focused on this useless conversation rather than taking positive steps and spending our energy to fix the problem. Only if all the affected people start contributing money, start organizing the state chapters, and start participating in the IV activities .. we will see some light at the end of the tunnel. It purplexes me that people use this forum to start war of words, just to keep them busy, but seldom use the forum to unite themselves and fight for the cause.
Please ... I do not want to offend people, just urging everyone to think really hard to solve the problem.

For some reason this does not sound right. If there was spillover of 20000+ visas (of course, this was an assumption), have we seen that many approvals? To me the approvals seemed normal, not much.

I am reviving this old thread because it was created by me, and it is highly relevant now. I predicted last month that EB2-I will become "U" soon, and it has happened (almost).
The quick way out of this mess is to ask CIS to move subst labor folks back in the queue. That will ensure that both EB3-I and EB2-I will move forward to July 07. Most of the labor substitution took place in that month itself.
This is an admin fix and does not require any new legislature. This is an idea whose time has come.
The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.
The basic thrust behind the idea of changing the rules of PD allocation for subst cases is to push forward PD to july 07 level. Most of the subst happened in that month. we are not asking subst labor folks to quit the queue, just asking them to move behind.

IV members, we need your stories. We are going to make an all out effort to pass this on to senators/media folks to realize the urgency of the situation.
Who's story do we need?
Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Mathematics and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
We have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV
Why we need your stories?
Media folks
Sometimes we get approached by journalists who need a story the very next day. They are looking for specific subjects for the story though.
An example is say the Investors Business Daily (a financial daily). A reporter might come to us and ask us if we have anyone from the Finance sector who is suffering due to retrogression and is willing to speak up about it. They might also add that we need only Eb1/Eb2 category folks.
When this happens, we are in a mad scramble to find folks who fit this criteria so that we do not lose this chance.
Another example might be of a Medical Journal looking for doctors stuck due to retrogression.
We are constantly getting requests like this but cannot capitalize on it because we do not have enough stories already available to fit the criteria.
So please send in your stories. It need not be earth shattering at all (most of us are mere mortals). You never know when a reporter is specifically looking for a story similar to yours and you might just tilt the balance in favor of skilled immigrants.
We promise we will not reveal your story to media if you do not want to.
Though there is no harm to reveal one's name in media as can be evidenced by the folks featured in the Roll Call article, Philly Inquirer and News Observer.
At the same time we understand that you might have reasons to remain out of media and we will fully respect that.

Even during the recess, we were talking to the staff of a ton of senators. Most of the time the senators' staff are interested only if someone from 'their constituency' is also affected. We always say we have a ton of folks from each state, but nothing works like a real example.
For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.
When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'
Lately when we go to meet them, most of the staff have already visited our website multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.

If you are talking about financial donations below model works best for me.
lets say IV core comes up with COST of doing X,Y, Z fixes within XX weeks.
COST is shared among wishing to donate. This becomes like a product purchase.
Current model is not time bound nor result oriented.
Again I am not anti-IV or anything. I am just expressing my idea!
Unfortunately the system does not work that way. Let me ask you this. If you believed in being result oriented and time bound and made an investment to file your green card, when do you think the investment will pay off? Some things money can't buy, it takes tonnes and tonnes of energy to make a change. Believe in this organization and invest your time in helping this organization.
Actively participate in all action items, mobilize your community, your state chapters. Spread awareness and build a sense of cohesiveness. Consider everyone here part of a family and remember everyone who works tirelessly work for all of us, not just them. Find out if there is anyway you can help, there are so many opportunities where IV needs all of us. Stand up, get up and move..

I disagree that substituted labors has really impacted immigration..Those labor certifications that were once filed were thought to be used for some one anyway. If the original applicant wasn't laid off or hadn't changed plans, he would still be ahead of the current pending applicants. It's not the biggest of our current problems.
Companies should not have filed GC for all the non-qualified idiots who are currently got ahead of us.

Saguar, this is not a simple issue and we cannot just this as an independent event. Yes these people are here ilegally but what do they do; work. Yes they work for meagre wages and reduce the price of commodities which would otherwise need to be imported from elsewhere. Now we have heard that due to some of the raids innocent children were torn apart from their parents who never came back from work. children came back from school to learn that they will never see their parents again. whole towns, churches and communities cried out in anguish when such events happen. The pain is tremendous. when you allow a problem to get so deep rooted into the society often the best way to handle it is to first accept it and then plan carefully. You cannot suddenly start deporting a minor fraction of these folks who have indeed contributed to the economy directly/indirectly. You can import cheap goods from other countries but people are now realizing that it is better to import labor and have work done here. This raids and intolerance has an element of hatred mixed in and it is not only about "law". Welcome to IV. There is no data available to us yet suggesting how many applicants that applied were for Masters quota. However masters quota would be definately filled very fast for you to apply this year before your OPT starts. We are trying hard to get an immigration bill bassed this year. First of all, It is funny that the guy who knowingly broke the law want help of law when he is victim. Now all of us know why laws are made in first place and why everyone should follow it.
Secondly, Beating the dead horse again, Thunderbolt should go to cops and give evidence of child abuse asap.
In terms of risking the case of hiring illegal for a job by going to the cops in my mind is a non issue. Because, he is exposed to that risk with or without going to cops himself. What if Nanny gets caught working illegal in some other home and she gives all names she worked for including thunderbolt. He has done a mistake and he should hire best attorney to plead that case if it ever comes up either by him reporting child abuse or some other way.
