At least for the consultation phase hire a good lawyer, there are scores of lawsuits filed each year but as long there was no life threatening injuries in an accident you can get out of it. This should not be a criminal conviction and should not hurt your gc process. Again I am just assuming the back up ended in some dent to the other persons vehicle or were they walking and you hit them there were injuries involved.

I agree. There haas to be a start. Like how Obama has promised he will make corporate CEOs accountable for the mess they create and move on, we must also jump start the community towards cleansing the system.

I think the idea is that we need to sell ourselves. I was the other day debating on www.cio.com and believe me, that was a tough exchange. Several US IT pros (mid management, engineering, etc) arguing that they are highly qualified and got laid off and cannot find a high paying job anymore. I had to sell myself and argue that our skills are needed, etc. I believe that we are still needed in this country and it is not all that easy to find "good" IT professionals. That's why we are here. However, I am very concious about the number of folks who Americans are willing to let in without hurting them.
"Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.
LogicLife is doing a good thing by being so positive. Let's continue to sell our skills in a professional manner. Just be careful with the idea of "demanding" and "rights" though :)

I have seen hard workers laid off left and right, be it US citizens, green card holders or H1Bs. In fact one of my GC friends said that it is a constant fear for him to be employed at all times, he was unemployed for 10 months after the dot com bust. That changed him completely, he said what will I do with my GC, can I feed my kids with a GC? I need a job. So it is everyone's perspective. I look at him and say at least you have a GC, he says at least you have a job. :)
I still think that GC is not a right. It is a privilege, as is a driving license. You have to pass the drivers test to get a license. Logiclife's message from centuries back about anyone being able to move to another country does not work in today's world. There were no visit visas needed to get to India or China for example in those years, but why is it a requirement to have a visa to visit India now? Things have changed.
BTW, I do think we should do what we can to improve the immigration process, but if nothing gets done its not the end of the world. We can "ask", "request" Congress to change laws. But surely you are not saying we "demand" for our rights to have a GC?

this seems to be the plan all along. Keeping pushing the ammendments and divert the discussion from the actual issues. A tactic to run down the clock, shows that he is doing something but nothing gets done. Helps the anti immigrants but royally screws us. Masti_guy - Don't worry about not having an MS. If people with MS move out of the queue the queue will autmatically move forward. There are a number of MS engineers working in EB3 positions especially the one who have never changed employers after they got out of school..

The expiration on the new I-94 after using AP is 1 year from the time the AP is used and not related to AP expiration date from my experience.
The I-94 date I received was 6 months beyond my AP expiration.

Lou Dobbs was in Orange County this weekend as a Keynote speaker at the The World Affairs Council of Orange County. He launched into his usual vitriolic diatribe, there were many business leaders at the forum and he ended up polarizing the crowd. Some felt that he is all talk with no practical real life experience managing companies, his ideas are over the top and cannot be implemented. He never ran or lead a fortune 500 company or held a major political office, yet he critiqued the very organizations who sponsored tables for this dinner. A few did get carried away by his speech, i have to say that the crowd at the back was cheering wildly for him while the executives in the front were subduded. BTW this person with socialist leanings has hefty appearance fees.
We would be better off not wasting our time on him or rebutting his indirect accusations, he is playing to his crowd. We should play to ours.

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

(A) The petitioner shall immediately notify the Service of any changes in the terms and conditions of employment of a beneficiary which may affect eligibility under section 101(a)(15)(H) of the Act and paragraph (h) of this section. An amended petition on Form I-129 should be filed when the petitioner continues to employ the beneficiary. If the petitioner no longer employs the beneficiary, the petitioner shall send a letter explaining the change(s) to the director who approved the petition.

If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K.
I would strongly disagree that H1 = cheap labor. It's only the H1B employer who pays low salaries, where as the client pays the same billing rate to all contractors (including US citizens). If a h1 employee is getting a low pay, then there's no one to blame except the employee, cuz he's allowing himself to get exploited.
I work for a major US corporation. I have seen H1 - LCA notices on my office notice board with salaries ranging from $100K to $110K. I personally know a friend who earns $100K on H1 and also an US citizen who earns $85K in the same office.
I have seen H1 holders driving Merc/BMW, whereas GC holders/Citizens driving a rundown Honda or Toyota Corolla.
Recently, one of my friend left his desi employer who was paying him $75K per annum and joined an US corporation by doing a H1 transfer for an annual salary of $135K per annum.
It all depends on your skills and how benefitial you are to the company. If you wanna reach the stars, then no one's gonna stop you.

If they dont count Dependents we all get GCs very soon . Unfortunately all dependents even kids are counted under employement category ..
One change - Counting a number for primary applicant can change thousands of lifes each year .

Thanks for the excellent info on pending applications. Now we can guess why EB3I is crawling for past few years.
With regular quota of 3000 per year EB3I (until July 2007) will be cleared in next 20+ years.
