Yes amitjoey. thanks a lot for that help. I wish more people participated in it. infact if more members can continue to do it today it will be very helpful. yesterday there were at least 3 mails from reporters expressing interest in us. This was because a few people wrote to them about IV and requested them to do a followup article abut us. I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact. It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).
Can we know names of these reporters who wanted to know about us? Also, is there any update on what QGA is doing on getting the word out about IV to the lawmakers? In her response to me, Clinton did not appear to indicate any knowledge of the severity of the problem that legal immigrants are facing due to retrogression.

I have some personal experience in this thing. In my case it was 750K, nevertheless a large some.
Question for you: Were there any injuries in the accident?
    Hi Gurus,

I need an advice from you.

    The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)

-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.

So what are my options now?

    1. Check with attorney and start defending..?
    2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
    3. What about my GC?

Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

    Thx,
    PD is Nov 2006.

This shows that the backlog is more than the numbers on USCIS website. People need to stop wasting time on tracking and spend time in their office work. Backlog means more business money for lawyers and trackers. IV is very small. Unless IV had hundreds of thousands of members, they cannot do lobbying like AILA or Microsoft. EB3 India and now EB3ROW is in a pitiable state. All those EB3ROW who used to be happy will now see the reality. Thank god I ported to EB2 but the dates for EB2 do not move enough. I think anyone who can should port to EB2 ASAP. This is the only solution.

You're right. No offence but no authority seems to be listening to IV suggestions. I agree that people at IV are doing great job, but the problem is nobody is listening. They just don't care. And this think will go on & on. I remember s'body suggesting hunger strike and at that point of time I thought that won't work. But now it seems we have to go extreme and do hunger strike and stuff to pressurize this crappy system.
EB3 people don't think I am being selfish here. The truth is we have to work unitely and pressurize for visa recapture. That will be beneficial for e'body.
Lets target the 'Asses' asking for a kick. Let's all kick ass.

I absolutely agree with Logiclife and all posts supporting him/her. IV Core, you guys rock. There is no question about your integrity or selflessness. I understand the Time, Money, Effort and Sacrifices many of you have made to fight for this common cause. Please do not get discouraged by some mindless posts. Remember that for every single disgruntled voice on this forum, there are hundreds of supporters. Albeit, some silent and some active.

Mr chaanakya, You may find this as a personal attack! But it is not. This is an attack on your thought process!

You claim that you received a PHD. But I seriously doubt whether the university that decorated you with a PHD evaluated your ability to think rationally and ability to reason!

Normally with education people achieve wisdom, knowledge, ability for rational thinking, ability to reason, humility, compassion and a better understanding of the functioning of the world.

I am not saying you do not have the right to complain or right to protest. You have and you definitely should have. But the approach that you have taken is the wrong one! In your post you criticize about people lamenting their plight! In reality, you are also doing the same, Am I correct?

If you are a real PHD, just go through the following post that you presented and analyze how you can improve that to make it a product from a REAL PHD!

If such an educated guy like you can become an opportunist, how you can expect higher standards from lesser mortals!

In another post you said that you were eligible for EB1 and couldn't go through that rout, are you lamenting here? If you are well qualified, why didn't you go through that rout?

    You said:

"You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job."

In the same token, Why you are not trying to achieve a suitable job at a suitable firm which will apply your GC in EB1? You have all the opportunities for that, right? Why can't you achieve a Nobel prize and obtain GC in a split second? Who is stopping you?

Just because, you did your masters and PHD from here, does that make you special? What about a guy who obtained Masters from G Britain? - Is he ineligible? Would you prefer special treatment over him? The point is, when you came here, you swore that you do not have any intention to immigrate, and you just have intentions to study and return to your home country - Try to remember, you did that in your F1 visa application form. So, my friend, nothing gives you a right to be here or to get GC. It is a privilege.

You need to understand one thing: Each person has different skills, living circumstances, responsibilities, and different type of blessing from the almighty. So, don't measure everyone with the same yard stick that you are using to measure and don't use your own selfmade standards.

If undocumented immigrants where also competing with you for a GC spot, you would have said, they also have the same opportunity here, why they are not taking masters and PHD to get their GCs sooner?

In reality, some are fortunate to reach your level, but not everyone! But that doesn't make them ineligible for the Pursuit of Happiness and Pursuit of a better life!

If you do have a real PHD, you should lead, you should be a role model for many and propel your energy in the positive direction instead of a stupid post like this! You can work to make things better in this country!

My point is, work hard and lead to improve the immigration related laws and procedures!

Last point I would like to mention: Dear friend, Just education alone will not make you a better person or a person with wisdom. Try to learn from life, lives of others, problems of others! I think, if you try, you can understand this better than me, because you have better education!

And please, don't speak for me: I am an EB2 Masters category guy.

Last message to all folks who express their feelings through red dots: Think before you act! Provide the real reason why you are giving a red dot. Don't just allow your emotions to control you.

Yes, that is right, I said “plight of EB2-India”.

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

If you have an older priority date (EB-2 or EB-3) such as 2004 or earlier, it would most likely be a waste of your time and money to file your adjustment now. It could take over a year and a half (if not longer) for a decision to be reached in the lawsuit, and chances are that your priority date would come current before then, making you eligible to file your adjustment.[/I]

--- Your lawyer is mistaken about "Waste o fmoney". There is no waste of money. FIling now will have rejection and thus no money waste. "Waste of time" is also can b ecounter argued as most of the people have already prepared their docs so therr is no additional waste of time and even for second time filing for most of the people, just changing date on forms wouldbe necessary so thus again it would not be a waste of time. Wonderful with BOA!!! but always looked bitter due to high wire transfer fee.

4-9 years ago, when used to send large amounts ($4000, my family was in India), I used BOA because I had bank account with them. They would charge me US$45 per transaction. Seeing that others are charging $10 or so, I reached Manager about such descripency. He explained that after taking $45, BOA becomes my representative and works in my best interest. He showed that last conversion rate was $1.50 more than any bank published rates in India on that date. So I made effectively $40-50 even after paying us $45. BOA manager explained that they gave Times Bank Indian Rupee. Had they given US$, Times Bank would have eaten all the profits.

    With others money transfer agencies:
#1. I always got approx. $1 less than published rates.
    #2. There has been delays
#3. They have deleberately taken more number of days to do transaction on that day, when rates were worst.

I never lost money by sending through BOA, it used to be $4000-5000. But since BOA charges $45, I could not use their services for money less than $2000.

$45 had made trustworthy partner, free/$3/$5/$10 made stealing partners.

But interestingly, so far the 70/30 ratio between yays and nays has been maintained. (As stated earlier, personally I thought it'd be much worse, more like 30/70 or 20/80 even... ) :)

    jazz

Guys, I'm not sure how useful this pole will be, since I suspect that those answering it will not be a statistically representative sample of IV membership, or it is at least hard to demonstrate that it is.

    Please realize that

    a) immigrationvoice.com is a tool for the Immigration Voice organization. This website/forum has 10K members, and in any population of 10,000 people, you will get all sorts and kinds of people. There will be no unanimity of views. So, when it doesn't cost to express an opinion, you will get lots of opinions.

As we get more and more members, the number of opinions is only going to increase.

ImmigrationVoice Organization on the other hand, consists of some influential core members who have been working on EB-based issues for more than a year. This organization also has some active state chapters.

I would request you and your like-minded friend not to confuse the organization with the website.
Join the organization. Thats what matters. The website is only a tool.

    b) The REAL POWER of this organization will lie in its state chapters. Trust me. If you sit with ten people you know, and talk about these issues, and resolve to do something about the situation, and come up with an action plan and an operating mechanism, that will be where the strength of IV lies.

This forum provides good live information (when there is a senate testimony, or call Senator session's office campaign going on), and sometimes useful information and announcements.

But most of the time, you will get opinions, and comic relief from here.

Friend of mine (to whom I contacted regarding IV) is in USA for 7 years and knows how lobbying & party funds are raised (including Watergate) and also very much aware of "Retrogression" and problems of being "Legal".

Also, he is aware of cause of IV and appreciate that but he is un-comfortable because whenever he login to IV, he noticed that:
    - more than 40-50% respondents are talking about money/contributions & signatures showing how much they have contributed as of today,
    - 10-15% are talking about blocking non-contributors(calling by Free Lunchers etc..),
    - 5 % are Pseudo intellectuals (talking BIG but dont know immigration basics like - PD, issues of I-140/I485)
    - 5% are always trying to shutdown others, accusing/calling by names to other forum members (he says "Highly skilled" in accusing!!)
    - and remaining are "Positive" contributors for IVs retrogression cause (talking about - I spoke to senators office, can we arrange rallies, when to Fax/fliers, when State chapters are going to meet, posting excerpts from senate/CSPAN/News etc..)

Is our audience is so? Can we focus on our cause? pl be together like.. Like-Minded!!!

I totally agree with you, I used to visit IV a lot, but was just disappointed with the results from some of its members. Not to blame IV core team, but other members who would just come and read blogs. Specially EAD holder's, I hope their eyes are opening up to new realities. Yesterday, my sister in law entered USA from Newark Airport and she witnessed three people holding HIB visas get cancelled at the immigration point, one had EAD.

All we Desi's want is a free ride, same old mentality, don't want to put in any diligence in this matter, but very quick on pointing short comings on others. Blame game!

Point is, we all need to do something radical, sending flowers again and holding a hunger strike, otherwise, keep coming to IV and keep getting disappointed.

Papu, maybe you can hold something up for once. Schedule a date for some event.

    Goodluck!

May I ask, who are you to strike anyone off?

Most of the people still survive and overcome the restrictions and stay here. Still Indian IT depends on US market. No country come to the level of US yet in technology. Companies will easily find a way for all those. Impact is not for country or Corporations but for future H1b aspirants
