    Dear Friends,

    Got Green cards and Welcome notices for me and my wife .
    Surprisingly no uscis e-mail and online status is still "initial review"

    Our journey in short :

    How long in US : 10+ years

    First Labor in 2002 . Changed job in three years before approval of labor
    Second Labor in 2004 . Approved in 2007
    Filed I140 and 485 - in July 2007

    Since then I was enjoying EAD / AP with no complain .

    I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
    From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
    My Lawyer told me that I can port to EB2 and it is a normal a process.

    1. New Perm
    Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )

    2. EB2 I140 (TSC)
    a. Filed in March - Premium Processing
    b. My Lawyer sent interfiling letter along with I140 filing
    c. Approved in 7 days (A# and Priority Date retained)
    d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
    e. No email and no updates on USCIS website

    Not sure about the USCIS and Lawyer fees . My company paid for every thing.
    Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

    I understand that IV has purchased a system (used at other places also). It may not be possible to configure it according to every requirement.

    I don't think IV has the source code for the system. Even if they have the source code, it will take a while to modify it according to all requirements.

    Exactly my thoughts. However, that does not mean that I am not proud of heritage and culture of my country-of-origin.

    The vast majority of people are here on these forums for getting their GC and USC.

    I appreciate everyone who has congratulated me. Thank you so much. Please note that I sill belong to legal immigrant community and nothing can change that.

    Anyway, I am still confused. If I am proud of my country of origin and its heritage then it must be absolutely impossible for me to entirely renounce and abjure all allegiance and fidelity with my country of origin. That is the expectation every human society or country generally have and must have to advance its own culture. Well I can not see myself fitting in that "Ethics watch" if I am changiing citizenship. If I am changing citizenship I absolutely do not have strong ethical connection with my heritage and country. And in that case it is fine to change citizenship for me and if I do that I would not speak about pride to my heritage and country. And if I am really and sincerely proud of my country of origin I would not become citizen of other country in spite of any attractive lure. It is that simple.

    One more thing. Working on EAD can be preferred to both categories, ppl who has consumed all 6 years and ppl who haven't yet.

    1. If you have consumed all 6 years, according to above link, can file MTR if 485 is wrongly denied due to AC21. EAD remains valid till atleast the appeal period. while if they are on H1 extension beyond 6 years, H1 is cancelled with immediate effect.

    2. PPL who haven't consumed 6 years have an added advantage to come back to H1 and guess what, he can (if needed) start a new GC process while retaining his older PD (as his 140 was once approved, he retains that PD for life).

    I found this by extremely intense research on internet, CIS website and many well-known lawyers forums, chats and discussion. However it is always advisable to consult your own attorney.

    Thanks for the additional information. In case 1 - can the applicant still retain the priority date if s/he wants to start a new GC process? In other words, does 6 year expiration have any effect on retaining PD?

    From what I have gathered so far, it appears that it's a misconception that a lot of people have who feel it's safer to stay on H1. It doesn't sound like EAD is as bad as I had once initially thought..

    Thanks. I have seen this document before, and if we are both looking at the same place (top of page 10), this is an average estimate that sweeps lot of detail under the carpet. USCIS's yearly updates (http://www.uscis.gov/files/article/Local%20Processing%20Times_FINAL_11Aug08.pdf) reveal more. As I said earlier, depending on where you live, your processing time can be anywhere between 5 and 15 months. From my visits to several naturalization-related threads, I have rarely seen anybody who became citizen under at least 1 year, going as far back as 2002. You are right, we won't expect another rush now as it was in year 2007 (compare the "Total" number naturalized in 2008 with that in 2007, Table 2, page 3, here (http://www.dhs.gov/xlibrary/assets/statistics/publications/natz_fr_2008.pdf)). But then, who knows what can happen after 5 years.

    To me; it looks like it could be a shift in change of policy. In the denial notice; it is the same officer number who sent the notice of intent to deny. Therefore; it is not a training issue; looks like something else is happening.

    training issue is when they send straght denial after 140 is revoked.

    Whatever be the shift in policy, they cannot go against the AC21 law, which is if the job is in similar classification then the applicant can use portability if the underlying I-140 is revoked. Also you must have seen the latest yates memo , link, http://www.uscis.gov/files/pressrelease/AC21Intrm122705.pdf

    If you see Q.11 it asks,
    Question 11. When is an I-140 no longer valid for porting purposes?
    Answer: An I-140 is no longer valid for porting purposes when:
    A. an I-140 is withdrawn before the alien�s I-485 has been pending 180 days, or
    B. an I-140 is denied or revoked at any time except when it is revoked based on a withdrawal that was submitted after an I-485 has been pending for 180 days.

    Answer B seems pretty vague. How do you interpret this?

    Also can you tell, if the case you are referring to is based in TSC or NSC. I have seen cases where TSC applicants are facing this kind of situations more.

    It is possible INS can track you down using posts here as you seem to be illegally here in the US. I wouldnt be advising anything to you as you are an illegal alien.

    At least one person is doing the right thing and you are asking him to be a coward ? What will INS do after tracking him down ?

    INS can't even track down the 12 million "really illegal " aliens that you and I see everyday around us and they will waste their time going after this guy who has already left the country.

    Get a grip on practical things in life.

    I finally get the chance to share our wonderful news with you all. We (me and my wife) received our "Welcome new resident" e-mails this morning.

    11 yrs for me and 12 yrs for my wife since coming to the USA. Between the two of us, Three J1s and Two F1 stamps, Six H1b stamps, Four 140s, 10 EAD/AP (5 each), 3 finger print notices apiece, Four RFEs between us and a total of $68KUSD in total USCIS fees/Lawyer fees and countless gray hair later and after many an emotional roller coaster over the years, it was our turn today.
    For those of you unclear about the admittedly weird above numbers, take a look at my RD. It is not a typo! I often wondered if I was a lone Dinosaur that survived the meteorite. I never saw anyone with a 4 plus year 485 recently.
    Our 485s were 2 yrs old and approvable when the visa bulletin fiasco happened in summer 2007. Ironically I heard that even my FPs/Background check were cleared by then (which in those days was the main cause of delays).

    I made many approaches over the years to the USCIS via phone, email, and fax, My Congressman contacted them on multiple occasions (atleast 3 times when he forwarded their response to me). I finally also wrote the ombudsman 2 weeks ago. I was pretty scathing in that letter as well (about their mockery of their stated FIFO policy etc). I am not sure exactly what worked, or if anything at all did, and it was just my time. After a while dealing with the injustice, you just get numb. Today finally I breathe a deep sigh of relief. The loooooong wait is over.

    I've spent so long waiting I even get nostalgic about the early days. I remember very well, blogging one cold December night on Immigrationportal with Wallenpond, Pdakwala, Superman,Khodalmd and many other early IV luminaries in 2005 putting up a rearguard uncoordinated effort, when Rep. Sensenbrenner scuttled our visa recapture chances in conference committee. Following which IV was born with leadership from folks well known to us now. IV is your organisation and platform. It will only be as strong as you let it be.

    I wish each of you all the best of luck and least agony in your wait. Those of you current, have faith, if you are being wronged, Stand up. Write/meet with those in a position to do something. Advocate for yourself. That way, atleast they know, what is going on. Otherwise none can help you.

    I will continue to stick around here and do what I can to help with IVs efforts. I believe with our overall effort, we are helping ourselves yes, but what we are advocating for is correct for this country as well.

    On March 30 I had a soft LUD on my 485 and then on Apr9 my attorney recd an RFE.in my case the RFE went only to the attorney.



    Hi all,

    Due to system glitches, cud a soft LUD mean that it cud still have triggered an RFE to the attorney?

    Also, when therez an RFE will the mail just go to the attny or to the applicant as well (if the applicant has signed G-28)?

    Bottomline, is it a good idea to check with the attny if there were any RFEs?

    The only difference between the historic data (1930/1960/1990) and 2008 is that, we are in globalized economy now. The crash you are seeing now is much much different than what anybody has seen before.

    Crude prices are crashing because the demand growth projections Goldman sachs had was based on availability of which is not the case now. So, demand for crude is lower and hence oil prices are crashing. Look at GM and ford. They are going down too, because auto sales are doomed for next 2 years.

    The problem why Gold will go up is multifold.
    China, OPEC countries have huge dollar reserves and hence would like to diversify their dollars. The run up in Gold is just because China and few Oil exporting countries were buying Gold. Gold still has more room to rise. I am talking about physical gold and not the paper gold (GLD ticker symbol).

    United States has to print dollars to meet the present crisis. At the same time, it has support those currency papers with Gold. Without Gold backing, dollar value will be crushed.
    I am goldsmith and i do know the history of Gold going back to decades. I also read several books to top it all.
    See the value of Gold after making inflation adjustments. Don't just look at the per ounce value in dollar terms.

    Unless you look at money supply (m3), you will not be able to get a grip on Gold value.
    Google on term 'brenton woods' and do some reading.

    The only way Gold can be crushed is if
    a) United States sells all its Gold holdings.
    b) If some gold miner miraculously says that they found a mine with billions of ounces of gold and which can profitably extracted.

    There is one theory floating around. United States may sell some of its gold reserves to make up for $700 Billions. However, there are buyers out there who would love to take that Gold. China's biggest headache right now is, what to do with their Dollars.

    United States long term bonds are going to yield nothing and will be worthless.

    We can go on this forever and fill these pages.

    Look at 1930/1960/1990 history you would understand why it make sense buy US bonds during stressed time because yield will go down and price will shoot up



    Eventually they will get out when they find there is no purchasing power on other side of globe. learn How gold crashed from $840 -$170 between 1981- 1990 and why gold price was stable between 1991-2001.

    Gold price would not shoot up when most of the developed countries banks are in trouble like 1989-1992

    I would not suggest more than 5% of your net worth in gold, but you should know your appetite

    China has to lend more of its reserve to western economies otherwise its own export will be in peril, so they would not invest in gold...

    Learn relationship between crude and gold, crude would go back to$50/barrel , so Arab govts would have not money to buy gold...




    Russians were stronger in 1970's and US crushed them to no where ,800 banks failed in 1990 and Japanese were stronger than today's Chinese economy but US smashed in 5 years


    If you understand how US crushed you would not laugh you would be happy that you are in best part of earth

    Moreover I am not saying I am right on everything , I am just writing what I feel , time has to judge our predictions.

    Do you know why economists are not best paid executives than scientist?

    You would understand laughing and bet would not make sense on capital markets.
