As per my attorney (one of the top 3 in the country), there is already more than enough proof of rejection, which means an actual rejection package is NOT needed at all to proceed with Class action law suite
Example is revised visa bulletin, and that IS sufficient.
Infact, i tried to get some info, but all i got was "something favourable might happen ". That's a very generic statement and means nothing according to me.
It very well could be deliberate, no rejection notices mean, the lawsuit will be weak.

Yes, AFAIK the FB spillover is added to the base quota and then divided between the ranks. At least I hope DoS and USCIS don't mess up with this calculation.
BTW: Where were you able to find this information?
its clearly written in Sep'2008 bulletin. However, seems like EB3-I wont' get any of it and all numbers will be given to EB2. we loose again.

All I have to say is .. do NOT bring parents or relatives to the US , period. Healthcare is pathetic and will rob you off tons of your hard-earned, precious savings. If you want to meet your parents/relatives, go to the home country but do not bring them here. I have heard far too many horror stories related to medical emergencies and the last thing I want is to put my parents in that kind of situation. In fact when my mother heard about the medical expenses here, she is terrifed to come here and wants me to come visit Pakistan instead, which I will gladly do.

Hi Everybody it is a great idea to reimburse aman. Absolutely we have to do it through IV. it is not good idea giving personal checks. what happens when Aman submits his federal taxes. he has to mention everything about the money trail. In America everything should be trailable especially money matters.
giving money through IV is safe for him and for everybody and there is an accountablity everywhere. As a core member he can collect his administrative costs.
So whatever the pledge amouts we are doing should be sent to IV then to Aman.

What some people forget on this forum is there was a guy not too long who was dying in six months and I am sure most of our situations are not so dire. Look we all will get GC, we are AOS pending it is a matter of a year here and a year there. But please do not fight like this, we are a community. Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.

You should not have gotton H1B visa in the first place, as H1b visas are for professionals and there are many professionals stuggle to get an h1b visas even after engineering degrees. In your case, IGNOU is a shame. Its worse than University of Pheonix. If you get a greencard in EB2, it will be a biggest mockery of the USCIS and department of labor.
I suggest you learn a thing or two about laws governing H1 and EB GC. From your various post it appears that you have absolutely no clue regarding these process nor do you know what a legitimate university is . Did you pass from a unaccredited university ??
BTW, one does not even need a degree for H1 .... absence of every 1 year of post secondary education can be substituted by 3 years of experience --- so US Government understands the importance of experience. Where can I find medical insurance for my parents with reasonable coverage with reasonable premium. Their age is between 55 to 60. Dont lose hope and dont lose sleep over it. I know it's easy to say...but just hang in there. Everything will be ok. As someone suggested, all you will be losing is at most 10K. Even that, you can transfer to some where else and should not be paying a cent. Why go now itself? Let's suppose that the judgement is not in your favour, may be , after a couple of years. Then you can quit your job and say you are leaving. I dont think they can stop you at that time. And I dont think they can make you work either, if you decided not to take up a job. Then file banktrupcy and go back to your country. Relax for a couple of years and then come back.
So, all i would suggest is stay calm and let the trial take it's course.
If you do not want to go through all this stress then as someone suggested , try for an out of court settlement. Tell them all you have is about 2K( take off all the money before that). Then they will know what your position is and might settle for that. Better take an attorney so that this is settled for once and all.
It's possible that the target might not even be you. There might be some millionaire in one of the other cars.
That's my 2 cents.
So, just stay cool man..you are not going to lose anything.

Citizenship is like getting an unlimited credit our existing credit card (GC). The more the limit the more flexibility we get. So let�s avoid bringing patriotic fervor into such posts.

Not sure if you are a lawyer or you have a lot of insight into things, but in real world, even lawmaking is unique and vague. Courts and judges go by how best the case is presented and how and in what angle it can be viewed from and how similar things were dealt with in past.
Litigation experts also look at the psychological aspect of stuff. what I want to say is, the entire process of litigation is a huge animal and we can never judge or assess that.
One of my cousin sister is a criminal lawyer in India and when we get to hear the inside scoop of how stuff is handled in courts you will be surprised that your common knowledge about the law is just not good enough.
There are a lot of factors that go into the so caled legal world and mere book knowledge may not be sufficient.
Your views are good, but they definitely are "bookish" in nature.

I haven't yet used the SBI-NY remittance service (registered only last week), but I do not need to open account with them. Instead, I can send money home (only to an existing SBI India account) directly from my credit card, using a specific remittance form. I find this arrangement convenient, but mailing the form for each such transaction adds to delay. I find your suggestion better instead, and also probably quicker.
